Who publishes this page

This page is published by the operator of the Pike Gazebo website, whose correspondence address is 4-20-10 Honcho, Funabashi, Chiba 273-0005, Japan. The operator can be reached at info@pikegazebo.com or on +81 47-673-1811. The operator's legal name and registration details are provided on request.

Ref. TOC-02 / Scope

What these conditions cover

These conditions apply to a review that you and the operator have agreed in a written scope. If the written scope says something different from this page, the written scope applies. The rules for using the website itself are in the Terms of Service.

Ref. TOC-03 / How a review is agreed

From enquiry to written scope

  • You describe what you would like looked at: how many suppliers, which of the three reviews, and any date that matters.
  • The operator replies with a written scope that names the review, the records needed, the deliverables, an indicative timeframe, the fee and whether consumption tax is included.
  • The review is commissioned when you accept the written scope. Payment method and timing are set out in it; none is fixed on this website.

Ref. TOC-04 / Your part

Records and authority

You confirm that you are entitled to commission the review for the company concerned, and that you are entitled to share the records you send. You provide records that are complete and accurate to the best of your knowledge, in a usable form, by the dates in the written scope. If records are late, incomplete or in a form that needs extra work, the indicative timeframe moves and, where the work grows, the scope and fee are revised with your written agreement before the work goes on.

A review of supplier terms reads the agreements you provide. If an agreement is covered by a confidentiality clause, it is for you to make sure that sharing it for this purpose is allowed.

Ref. TOC-05 / Confidentiality

How records are treated

The operator treats the records you send as confidential, uses them only for the review they were sent for, and does not show them to your suppliers or to other clients. A written non-disclosure agreement can be put in place before any records are sent if you ask for one in your first message. Information that is public, or was already known to the operator, or is required by law to be disclosed, is outside this.

Ref. TOC-06 / What the report is

Information, not advice

The report describes what the records you supplied show at the time they were supplied. It is not legal advice, tax or accounting advice, an audit or a valuation. Comparing contract terms is not the same as interpreting them in law; a clause that needs a legal reading is flagged for a lawyer to read. You decide what to do with the report, and you remain responsible for decisions you make on the strength of it.

Ref. TOC-07 / What is not promised

Results

No saving, price reduction, shorter lead time, lower stock, supplier outcome or other result is promised. A review may find nothing of concern, and that is a valid result. The indicative timeframes on the website are planning figures; the written scope states the timeframe that applies.

Ref. TOC-08 / Fees and changes

Payment, changes and cancellation

The fee is the one stated in the written scope. Payment method and timing are agreed there. Work outside the written scope is added only with your written agreement. You or the operator may end a review before it is finished by telling the other in writing. How any fee for work already done is treated is stated in the written scope, and is never more than the law allows.

Ref. TOC-09 / Liability

Responsibility on both sides

The operator carries out the review with reasonable care and skill. Nothing in these conditions excludes or limits a liability that cannot lawfully be excluded or limited, including rights you have under the Consumer Contract Act where it applies. Neither side is responsible for delay or failure caused by events beyond reasonable control. The operator has not published details of any insurance on this site; if insurance matters to you for a particular review, ask for it in writing before you accept the written scope.

Ref. TOC-10 / Law and changes

Governing law

These conditions are governed by the laws of Japan, and disputes are handled by the courts that have jurisdiction under Japanese law. If any clause turns out to be unenforceable, the rest continues to apply. The conditions may be updated; the version that applies to a review is the one in force when you accepted the written scope.
